MINUTES OF MEETING OF SEPTEMBER 3, 2003, 4:00 P.M., SENIOR CENTER

Meeting called to order under the Wetlands Protection Act and the Wellfleet Environmental Protection Bylaw at 4:05 p.m. by Chair Ed Reynolds.
Business Meeting.
- Mail was reviewed.
- The Minutes of 7/16/03 were approved as amended, as MOVED by Moe,SECONDED by DiBlasio, and CARRIED 5-0.
- The Minutes of 8/20/03 were approved, as MOVED by DiBlasio,
SECONDED by Page, and CARRIED 5-0.
- Beach clean-up at Newcomb Hollow was done on 8/31.
- Ginie Page reported that aquaculture trash removed from Egg Island has been left close to a vernal pool in the area of the sandpit. It was agreed that a site inspection should be made, and the matter discussed with the Shellfish Constable on 10/1. It will also be suggested to the DPW Director that a special section of the Transfer Station be created for such trash.
- Ms. Page also reported that High Toss Road at Snake Creek is
being widened by the passage of heavy vehicles.
- Paul Banner reported on the Audubon walkabout on Indian Neck.
There was discussion of enforcement of the leash law for dogs
on Town beaches and a possible ban for the inner harbor. There was also discussion of the impact of the shellfish grants on the flats.
5:00. National Park Service, RDA, Map 19, Old Chequessett Neck Road cul-de-sac: Monitoring well for saltwater intrusion. John Portnoy said the well will measure any changes in the interface between fresh and salt water from opening the dike, with reference to possible saltwater intrusion into domestic wells. Two other wells will be located on private property. Monitoring will initially be monthly, and later at greater intervals. Cyndi Moe MOVED "that the Conservation Commission make a Determination of Applicability, Negative #3." SECONDED by Paul BAnner and CARRIED 5-0.
5:15. Caroline Parlante, RDA, 50 Kendrick Avenue, Map 20, Lot 3:
Replace & enlarge walk-in cooler. Ms. Parlante said the walk-in cooler will be enlarged by 7 feet, and a new pad put underneath.
John DiBlasio MOVED "that the Conservation Commission make a Determination of Applicability, Negative #3." SECONDED by Cyndi Moe and CARRIED 5-0.
5:30. Jonathan Porteus, RDA, 1003 G Street, Map 30, Lot 146: Replace retaining wall; repair parking area. Mr. Porteus said the bank is moving out and losing its straight. He described how the work will be done. Cyndi Moe MOVED "that the Conservation Commission make a Determination of Applicability, Negative #3." SECONDED by Paul Banner and CARRIED 5-0.

5:35. Irmgard Boriskin, NOI, 101 Commercial Street, Map 21, Lot 127: Construct garage and septic system; demolish restaurant building and replace with dwelling, (Continued from 8/6/03.)
David Lajoie presented a revised plan showing the garage moved out of the buffer zone; the house moved further back and rotated so that it stays the same distance from the top of the bank as the existing structure; a slab for a deck, with the existing deck to be removed; and the driveway slightly reduced with the area to be revegetated slightly enlarged. There was discussion of having three structures on the lot plus the slab for deck. Mr. Lajoie noted that the applicant has compromised and done what the Commission asked her to do, get the garage out of the buffer zone and move the house back. The consensus was that this is so. Paul Banner MOVED "that the Conservation Commission approve Felco Plan #02225, as revised 8/30/03, subject to conditions specified." SECONDED by John DiBlasio and CARRIED

6:00. Marie Lovely, NOI, 30 Kendrick Avenue, Map 20, Lot 1: Septic system upgrade; relocation of water lines. (Cont. from 8/6/03.)
Stephanie Sequin said the plan is being reviewed by the Board of Health and no major changes need to be made. She has added a Note
regarding the ACEC as Commissioners requested. She reviewed the Construction Protocol with Commissioners. The presence of Phragmites on the east side was noted. After some discussion it was agreed that the plan could be approved with a condition that the approval does not constitute the Commission's acceptance of the delineation of the wetland on the east side. Cyndi Moe MOVED "that the Conservation Commission approve Ryder & Wilcox Plan #8558, pages 1-2-3, as revised 8/27/03, subject to conditions specified." SECONDED by Ginie Page and CARRIED 5-0. Conditions were set.

Other Business.
- Rebecca Dalmas, Enforcement Order. Ms. Dalmas said she cannot afford to have a survey done in order to file a Notice of Intent and would like simply to cease removing grape vines, and plant 5
Tupelo tress and Clump Grass in mitigation for removal of vegetation. Commissioners agreed. MOVED by Cyndi Moe, SECONDED by John DiBlasio, and CARRIED 5-0.
